President of India Article 52 to 61







The President is the highest position in the country of India, all the activities of the country go on only after the signature of the President, formally the power of the country is with the President.


What is Article 52 of the Indian Constitution ?


Office of the President The President is the formal (nominal) head of the country. The office of the President has been taken from Britain. 


What is Article 53 of the Indian Constitution ?

 

The formal head of the executive is the President. That is, all the work will be done after the signature of the President. The real head of the executive is the PM


What is Article 54 of the Indian Constitution ?


Election of the President Its election is indirect through the single transferred proportional system.


Proportional method:-  By this method, all the candidates have to vote in the order of preference in the election.

Single Transferable:- By this adding the vote of the candidate who got the least votes to the vote of the candidate who got more votes are being given.


First Phase Counting:- In this the first priority list of the candidate is counted. 


Second phase:-  In this the second priority list is counted. That happens after math is equal in the first phase.


  • At the time of V. Giro's election, the counting of votes took place in the second phase.

Indirect Voting:- The public does not participate in the election of the President, but the representatives elected by the public participate.

Electoral College of the President Lok Sabha, Rajya Sabha and all states (292) Delhi.








Elected members from Pondicherry participate. The 12 nominated members of the Legislative Council Rajya Sabha and 2 Anglo Indians of the Lok Sabha do not participate in the election of the President. When the Chief Minister is a member of the Legislative Council, he will not participate in the election of the President.

By the 69th Amendment in 1990, Legislative Assemblies were formed in Delhi and Pondicherry. 

Delhi and Pondicherry were included in the President's Electoral College by the 70th Amendment in 1990.


President's bail amount :-


Before contesting the election, the President had to keep Rs 15,000 as security with the RBI. If the President gets less than 1/6th of the votes, then the security amount of the President will be forfeited.


This is called bail forfeiture. This is a state of humiliation. 

What is Article 55 of the Indian Constitution ?

In this it is called the quota of the President.

  • Quota = (Total Vote) / (Total Candidate + 1) + 1


What is Article 56 of the Indian Constitution ?


It deals with the tenure of the President. President's term.The post becomes vacant before 5 years. so the new president went for 5 years

  • He must be a citizen of India
  • 35 years of age
  • Become a member of the Lok Sabha
  • 50 proponents and 50 negatives.

Conditions 


  1. not be insane or insolvent
  2. not hold the office of profit
